THIS IS A LEGAL AGREEMENT BETWEEN YOU AND OBSESSED GARAGE LLC.
BY SUBMITTING THE ONLINE APPLICATION IN Refersion AND/OR PARTICIPATING IN THE PROGRAM, YOU CONFIRM YOU HAVE READ, UNDERSTAND, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS.

1) Overview
This Agreement contains the complete terms for participation in the Obsessed Garage Affiliate Program. The Program allows you to use Refersion tracking links (HTML or otherwise) from your website or channels to the Obsessed Garage website.

2) Enrollment & Eligibility
• Apply via Refersion. We may approve, request more info, or reject at our sole discretion. Participation is non-transferable.
• We may decline or terminate if your site or activity is unsuitable, including content that is illegal; infringes IP; promotes sexually explicit materials, violence, or discrimination; uses “Obsessed Garage” (or misspellings/variants) in a domain; is harmful, defamatory, obscene, harassing, or otherwise objectionable; or contains software that could divert commissions.
• You may not design or operate any site that resembles or is likely to cause confusion with Obsessed Garage, nor imply you are Obsessed Garage or an affiliated business.

3) Program Rules — Traffic, Promotions & Advertising
3.1 Non-Paid Traffic Only (Core Rule)
Obsessed Garage does not pay commissions on any order where the customer session originated from a search engine or paid media. Ineligible sources include:
• Search engines and their properties (e.g., google.com, bing.com, duckduckgo.com, yahoo.com) and any ads platform/placement.
• Traffic marked as paid by UTM or ad click identifiers (e.g., utm_medium=cpc/paid_social/display/shopping, gclid, msclkid, fbclid, ttclid) unless we give prior written approval.
• Paid search, paid social, shopping ads, boosted posts, whitelisting/allow-listing, programmatic/retargeting/display, or direct-linking ads to our site.
3.2 Allowed Traffic (Non-Paid Examples)
Original, non-paid content you publish: editorial on your site, organic YouTube, organic social, relevant forums/subreddits you actively contribute to (no spam), and opt-in email newsletters you own (must comply with FTC/CAN-SPAM/anti-spam laws).
3.3 Email, Forums & Identity
You may email your own subscribers and post where commercial messages are welcome. You must accurately represent your identity, domain, and return email. No spam of any kind.
3.4 Coupon/Deal Policy
Coupon/deal, cashback, toolbar, or extension sites are prohibited unless explicitly approved in writing. No code scraping, posting non-public or expired codes, or coupon arbitrage. No self-purchases to earn commission, and no tactics that repeatedly pay the same individual via discount cycles.
3.5 Brand Bidding & Trademark Use
• No bidding on “Obsessed Garage,” our domains, misspellings, or branded product terms in any ad platform.
• No use of our brand terms in ad copy, display URLs, or as paid destinations.
• No direct-linking paid ads to our site.
3.6 Software Interference & “Parasiteware”
No interstitials, toolbars, add-ons, shopping wallets, deceptive pop-ups/unders, hidden iframes, or applications that set/overwrite cookies or inject/replace/obscure content. This includes any software that:
(a) overwrites tracking cookies other than via a user-initiated click;
(b) intercepts searches to redirect traffic or place cookies;
(c) sets cookies via iframes/hidden links/auto pop-ups;
(d) targets text on third-party sites for contextual marketing; or
(e) removes/replaces/blocks affiliate banners not owned by the app owner.

4) Links, Assets & Site Monitoring
Use only the Refersion links/HTML and approved creatives we provide. We may review your placements and require changes. You are responsible for maintaining and updating your properties and for complying with all IP and other applicable laws; you must have permission for any third-party materials you use.

5) Tracking, Attribution, Cookie, and Reversals
• Attribution: Last-click in Refersion at the time of purchase.
• Cookie window: 15 days.
• Reversals/Non-Qualifying Orders: Fraudulent, high-risk, cancelled, refunded, or chargebacked orders are ineligible or may be reversed.
• If any paid media (3.1) appears anywhere in the customer path before purchase, no commission is payable—even if your link is later in the path.
• We may review traffic quality, request source substantiation, and withhold or reverse commissions while under review.

6) Offers, Coupons & Pricing
Promote only public offers or codes assigned to you. If a shopper uses a different code or a public promo, commission is payable only if your click is last-click and all rules are met. Pricing, promos, and availability may change without notice.

7) Commissions & Payments
• Commission rate: 5% starting; up to 10% may be earned per Obsessed Garage written tier/bonus rules.
• Minimum payout: $20.
• Schedule: Net 30 after the order ships and the return window passes.
• Tracking and payouts are handled via Refersion; its platform terms apply in addition to this Agreement. You are responsible for accurate payment details and any related fees.

8) Access to Affiliate Account Interface
You will create a password for Refersion’s secure affiliate dashboard, where you can access links, creatives, coupon tracking, and reports describing our calculation of commissions due.

9) Rights, Suspension & Termination
We may monitor your properties for compliance and require changes. We may suspend or terminate your participation at any time for any reason, including suspected fraud, abuse, policy violations, or failure to implement requested changes. Either party may terminate with written notice (email suffices). If fraud/abuse is detected, commissions tied to such activity will not be paid. Upon termination, unpaid commissions tied to non-qualifying traffic are void.

10) Modifications
We may modify this Agreement (including commission rates, cookie window, and rules) at any time in our discretion. We will notify you (e.g., by email or posting). Your continued participation after notice constitutes acceptance. If unacceptable, your remedy is to terminate participation.

11) License & Brand Materials
We grant you a non-exclusive, non-transferable, revocable license to (i) access our site via Program links and (ii) use our approved logos, trade names, and marks solely to promote Obsessed Garage under this Agreement. All goodwill in the marks inures to Obsessed Garage. Do not use either party’s proprietary materials in a disparaging, misleading, or obscene manner.

12) FTC Compliance & Content Accuracy
You must comply with FTC endorsement/disclosure rules (clear, conspicuous disclosures such as “affiliate link” or “#ad”). Keep product information accurate and do not make unsupported claims.

13) Taxes & Forms
You are responsible for all taxes on your earnings. We may require applicable tax forms before releasing payments.

14) Disclaimer
Obsessed Garage provides the Program, site, and materials “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

15) Limitations of Liability
To the maximum extent permitted by law, Obsessed Garage is not liable for indirect, incidental, consequential, special, or exemplary damages (including loss of revenue, profits, goodwill, or business), even if advised of the possibility. In no event will Obsessed Garage’s cumulative liability exceed the total commissions actually paid to you under this Agreement.

16) Representations & Warranties (by You)
You represent and warrant that: (a) this Agreement is duly executed and binding; (b) you have full authority to enter and perform; and (c) you have sufficient rights in the materials and channels you use to promote Obsessed Garage.

17) Indemnification
You will defend, indemnify, and hold harmless Obsessed Garage and its affiliates, officers, directors, employees, agents, owners, and representatives from claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your sites, content, promotions, or breach of this Agreement, including IP infringement claims related to your materials.

18) Confidentiality
Non-public business, technical, financial, or customer information marked or reasonably understood as confidential will be kept confidential and used only for Program performance.

19) Miscellaneous
• Independent Contractor: You are independent; no partnership, joint venture, agency, franchise, sales rep, or employment relationship exists. You may not bind Obsessed Garage.
• Assignment: Neither party may assign without written consent, except to a successor acquiring substantially all business/assets.
• Entire Agreement: This is the complete agreement and supersedes prior communications.
• Amendments/Waivers: Must be in writing and signed by Obsessed Garage; no waiver by conduct.
• Headings: For convenience only.
• Severability: If any provision is unenforceable, it will be limited/eliminated to the minimum extent necessary; the remainder remains in effect.
• Governing Law & Venue: Florida law (without regard to conflicts rules). Exclusive venue/jurisdiction lies in the state or federal courts located in Florida.
